We facilitate the connection between customers seeking vehicle shipping services and independent third-party motor carriers who provide the actual transportation services.

2. Scope of Services

Our services include:

  • Generating shipping quotes based on vehicle and route information
  • Sourcing qualified motor carriers for your shipment
  • Coordinating pickup and delivery logistics
  • Providing customer communication and support
  • Assisting with claim procedures

We do not provide transportation services ourselves. Any transportation is provided exclusively by third-party carriers.

3. Quotes, Pricing & Availability

Quotes provided are estimates only and not guarantees. The following terms apply to all quotes:

  • Quotes are valid for 7 days from the date issued
  • Final pricing is confirmed only upon carrier assignment
  • Prices may change based on vehicle availability, seasonality, fuel costs, and market conditions
  • Vehicle condition disclosed during the quote process affects final pricing
  • Actual pickup and delivery dates depend on carrier availability and scheduling
  • Additional charges may apply for special requirements (enclosed transport, expedited service, etc.)

4. Deposits, Payments & Refunds

This section is critical to understand before booking.

Deposit Requirements:

  • A deposit may be required to secure your booking, as specified in the quote and booking confirmation
  • Deposits are charged to establish your shipment with a carrier
  • Final payment is due upon carrier assignment or as otherwise agreed

Refund Policy:

  • If you cancel 7+ days before the scheduled pickup date, your deposit is refundable minus a non-refundable administrative fee
  • If you cancel within 7 days of the scheduled pickup date, the deposit is forfeited
  • If a carrier cancels or fails to arrive during the scheduled pickup window, you may reschedule or request a different carrier without losing your deposit
  • If your pickup window expires without carrier pickup (due to no fault of Aphelion Auto or your fault), the deposit is forfeited and rescheduling fees may apply

Payment Methods:

  • We accept credit cards, debit cards, and bank transfers
  • All payments must be made in USD
  • Chargeback disputes are subject to additional investigation and verification

5. Cancellations & Rescheduling

Cancellation Policy:

  • Cancellations made 7+ days before pickup date: Deposit refund minus administrative fee
  • Cancellations made 1-7 days before pickup date: Deposit is forfeited
  • Cancellations made after pickup window has passed: Deposit is forfeited; new booking required with new deposit

Rescheduling:

  • You may reschedule your shipment without penalty if requested 7+ days before the scheduled pickup date
  • Rescheduling within 7 days may incur additional fees
  • Rescheduled bookings are subject to carrier availability
  • All rescheduling requests must be made directly with Aphelion Auto

6. Carrier Delays, Damage & Claims

This is a critical liability section. Please read carefully.

Carrier Responsibility:

  • Motor carriers are solely responsible for vehicle transportation, timing, and condition during transit
  • Aphelion Auto is NOT liable for:
  • Carrier delays or missed pickup/delivery windows
  • Vehicle damage during transit
  • Acts of God, weather, traffic accidents, or mechanical issues
  • Carrier misconduct or service failures
  • Theft or loss of vehicle
  • Changes in fuel prices or market rates after booking

Filing Claims:

  • Any damage or loss claims must be filed directly with the motor carrier, not with Aphelion Auto
  • Claims must be documented with photos and filed within the timeframe specified by the carrier's insurance
  • Aphelion Auto will assist in claim coordination but is not responsible for claim settlements
  • Claim resolution time varies by carrier and insurance company

7. Customer Responsibilities

By using our services, you agree to:

  • Provide accurate vehicle information: Make, model, year, VIN, and current condition
  • Disclose vehicle condition honestly: Operable vs. inoperable, modifications, mechanical issues, and exterior damage
  • Ensure vehicle readiness: Remove personal items, ensure fuel levels are low, and vehicle is ready for loading
  • Provide correct locations: Accurate pickup and delivery addresses, including GPS coordinates if possible
  • Maintain legal authority: You own or have legal authority to ship the vehicle
  • Be available for pickup: Be present during the scheduled pickup window with keys and documentation
  • Notify of changes immediately: Contact us immediately if pickup/delivery details change

Failure to meet these responsibilities may result in shipment delays, cancellations, or additional fees.

8. SMS & Communications Terms

By providing your mobile phone number, you consent to receive SMS and text message communications from Aphelion Auto regarding your shipment, quotes, and promotions.

Your Consent:

  • You expressly authorize Aphelion Auto to send SMS messages to your provided phone number
  • This consent is not a condition of purchase—you can use our services without opting into SMS
  • Message frequency may vary based on shipment status and marketing communications
  • Standard message and data rates apply per your wireless carrier's plan

SMS Opt-Out:

  • Reply "STOP" to any SMS message to unsubscribe from all future messages
  • Reply "HELP" for additional assistance or contact us directly
  • After opting out, you will receive one final confirmation message and will no longer receive SMS messages unless you opt in again

9. Acceptable Use Policy

  • Aphelion Auto's total liability for any claim related to our services shall not exceed the fees you paid to Aphelion Auto in the 12 months preceding the claim
  • We are NOT liable for indirect, incidental, consequential, special, or punitive damages
  • We are NOT liable for carrier conduct, delays, damage, or service failures
  • We are NOT liable for data loss, business interruption, or lost profits

11. Indemnification

You agree to defend, indemnify, and hold harmless Aphelion Auto, its owners, employees, and agents from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your misrepresentation of vehicle information or condition
  • Your violation of applicable laws or regulations
  • Your unauthorized use of our platform
  • Claims by third parties related to your shipment or vehicle

12. Governing Law & Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law provisions
  • Any legal action or proceeding related to these Terms shall be brought exclusively in the state or federal courts located in Florida
  • You agree to submit to the personal jurisdiction of such courts

13. Arbitration & Dispute Resolution

IMPORTANT: By using our services, you agree to resolve disputes through binding arbitration rather than litigation.

Arbitration Terms:

  • Any claim or dispute shall be resolved by binding arbitration administered by JAMS
  • Arbitration shall take place in Florida
  • You waive your right to jury trial
  • You waive your right to bring a class action or class lawsuit
  • Each party bears its own arbitration costs, except where prohibited by law or as awarded by the arbitrator

Exceptions to Arbitration:

  • Small claims court disputes (under $5,000) may proceed in court
  • Intellectual property infringement claims are exempt from this provision

14. Modifications to These Terms
